The perils of cutting corners: a review of Hampton v STM Fiduciaire

The 2016 MONEYVAL report confirmed that Jersey is a financial services success story. However, as this recent Tribunal decision demonstrates, a combination of regulatory and performance pressures may motivate some staff to cut corners.

A failure to meet regulatory requirements can have huge repercussions, both for individuals and businesses.

At this timely workshop, Advocate Vicky Milner (Vicky) will show how Jersey financial services and employment issues overlap, by reference to cases including Hampton v STM Fiduciaire

Hampton v STM Fiduciaire - In this case, the employer (STM) was able to defend the unfair dismissal claim brought by its former employee (Hamilton) and the actions taken by the employer provide useful guidance for other organisations in dealing with similar issues.

Vicky will consider the need for regulated firms to address and understand HR challenges that all regulated firms face, including:-

  1. RECRUITMENT
  2. MANAGING PERFORMANCE AND DISCIPLINARY MATTERS
  3. STRESS/WORKPLACE HEALTH & SAFETY
  4. DISMISSAL
